This category includes the use of music in the cafe, bar, restaurant or other catering establishments through the jukebox or karaoke systems with pay-per-use (technical device). Since the profit of the establishment depends on the use and reproduction of music by technical means, the conclusion of a licensing agreement on the use of musical works and copyright royalties payments are obligatory imposed on the owner of a technical device.
The sum of author’s remuneration (royalties) shall be calculated in accordance with Resolution of the Cabinet of Ministers of Ukraine on January 18, 2003 № 72 “On approval of the minimum rates of remuneration (royalty) for the use of copyright and related rights”.
According to the Resolution, the minimum rate of author’s remuneration is 1% of income derived from the activity during which the works are used.
