Music that is used in salesrooms of stores, shopping malls, etc. creates a certain atmosphere and aims to achieve marketing goals.

In accordance with marketing “techniques” calm music is played in salesrooms to relax customers. In this state more that usual goods are purchased , much more than it is necessary for buyer at the moment. If, for example, the trade hall is gathered with a lot of customers – a fast, energetic music will be turned on. It accelerates the choice of the buyer, and he comes out of the store in a few minutes making room for the next customer. Without musical accompaniment trade passes slower.

Please note that in the case of use of music in economic activities (mood music (including the background music) on the premises of the shops, boutiques, supermarkets, shopping malls it is obligatory to conclude a licensing agreement. Such kind of permission (license agreement) must be obtained regardless of the methods and forms of use of musical works (as well the authorization required in the case of playback of CD, DVD, audiocassette tapes via music center or a computer, in the case of use a TV, a radio – receiver or other similar methods etc.).

Amount of royaltiesshall be calculated in accordance with Resolution of the Cabinet of Ministers of Ukraine on January 18, 2003 № 72 “On approval of the minimum rates of remuneration (royalty) for the use of copyright and related rights”.

According to the Resolution, the minimum rate of author’s remuneration is 1% of income derived from the activity during which the works are used.
