We inform that on July 22, 2018, the Law of Ukraine No. 2415 “On Effective Management of the Rights of Owners in the Sphere of Copyright and (or) Related Rights” came into force (the “Law”), according to which, in particular, a procedure for the transfer of rights and obligations was envisaged The State Agency “Ukrainian Agency for Copyright and Related Rights” (hereinafter referred SO-UACRR) to another non-governmental organization (in terms of management of the property rights of legal owners), which will receive accreditation by the Ministry of Economic Development and Trade: http://zakon5.rada.gov.ua/laws/show/2415-19/page

To this end, the Ministry of Economic Development has started preparatory procedures: http://uacrr.org/en/the-ministry-of-economic-development-has-started-preparations/

Such a procedure includes, in particular:

1. a) convening a meeting of delegates from the number of legal owners – individuals who transferred SO-UACRR the property rights they own;
2. b) the creation of delegates of a new public organization for the management of property rights;
3. c) accreditation of the newly established non-governmental organization as a collective management organization (OСU) in accordance with the requirements of the new legislation on such organizations.

In order to ensure the continuity of the rights and interests of the right holders, the reorganization of agreements on the management of property rights with another, founded by you – the owner of the organization will occur only after the procedures provided for by law. The beginning of the procedure for the conversion of contracts with the right holders will be reported in addition to the official resources of the Ministry of Economic Development and Development of the Ministry of Economic Development and SO-UACRR.

We draw your attention to the fact that the premature termination of the agreements with the SO-UACRR and their conclusion with third parties will not enable you – the right holders to be the founders of your organization that will govern your rights and may have negative consequences for you – the rights holders in the form of a complication of opportunity obtaining the author’s reward.
