Announcement of the appeal to the right holders and organizations with which SO UACRR has agreements with a proposal to replace the party in the contract.
The Ministry of Economy, in accordance with clauses 4-5 of Section VI “Final and Transitional Provisions” of the Law of Ukraine “On Effective Management of Property Rights of Copyright Holders in the Sphere of Copyright and (or) Related Rights” (Law №2415), continues to take measures to bring collective management of copyright carried out by the State Organization “Ukrainian Agency of Copyright and Related Rights” (SO UACRR) in accordance with the requirements of the Law.
The participants of meeting of the rights holders – individuals, who transferred their property rights to the SO UACRR, which was held on December 3, 2018, became the founders of the Non-governmental organization “The Community of Authors of Ukraine” (NGO “CAU”), which was registered as a collective management organization by the Order №3 of the Ministry of Economy dated September 5, 2019, as well as information was entered in the Register of Collective Management Organizations.
Subject to the requirements of Section VI, Section 4 of the Final and Transitional Provisions of the Law №2415, the Ministry of Economyappeals to persons (including owners, other organizations of collective management, including similar foreign organizations, international organizations), with which SO UACRR concluded agreements, with a proposal to replace the CAU as a party to the agreement instead of to SO UACRR.
Reference: NGO “The Community of Authors of Ukraine”is a collective management organization, registered in accordance with the order of the Ministry of Economic Development, Trade and Agriculture of Ukraine dated September 5, 2019 № 3.
Pursuant to the aforementioned order, СAU can carry out its activity in any sphere of voluntary collective management.
СAU is not an accredited collective management organization and is not allowed to carry out activities in the fields of compulsory and expanded collective management until its accreditation in accordance with the procedure established by Law №2415.
