On the invalidation of certificates on the account of collective management organizations and on the authorization of collective management organizations
October 28, 2019 was announced the deadline for accepting applications for accreditation of collective management organizations in the following areas:
– public performance of non-dramatic musical works;
– public announcement of non-dramatic musical works;
– reprographic reproduction;
– resale right;
– home reproduction;
In accordance with the requirements of paragraph 2 of section VI “Final and Transitional Provisions” of the Law №2415 of the announced by the Institution in accordance with part four of Article 16 of this Law, deadline for accepting the application for participation in the competition for accreditation in the relevant field (October 28, 2019) certificates on the registration of collective management organizations, on the definition of collective management organizations authorized, on the authorization of collective management organizations issued before this Law come into force are invalid.
Thus, as of October 28, 2019, all collective management organization certificates and certificates of authorization of collective management organizations issued prior the entry into force of this Law have become invalid.
Therefore, as of today, none of the collective management organizations, except the State Organization “Ukrainian Agency of Copyright and Related Rights”, can carry out the activity of collecting and paying royalties in the fields of applications which ended on October 28, 2019.
The State Organization “Ukrainian Agency of Copyright and Related Rights” (Collective Management Organization Certificate №3/2003 dated 22.08.2003) continues its activity until the completion of the procedures stipulated in clauses 4-5 of Section VI “Final and Transitional Provisions” of the Law № 2415.
We also announce that according to the results of the meetings of the commission on accreditation of collective management organizations, 3 organizations were accredited:
– Public Association “Ukrainian League of Copyright and Related Rights” in the field of extended management: “the right to a fair remuneration common to performers and producers of phonograms (videograms), for the public performance of phonograms and recorded performances, or the public demonstration of videograms and recorded performances, published for commercial use”;
– Public Association “Ukrainian Music Alliance” in the field of extended management: “the right to a fair remuneration common to performers and producers of phonograms (videograms), for public announcement of phonograms and recorded performances, videograms and recorded performances published for commercial use purpose other than cable relay”;
– Public Association “Coalition of Audiovisual and Music Rights” in the field of compulsory management: “cable relaying of copyright and (or) related rights, in addition to broadcasting organizations’ rights to their own broadcast programs.”
